The split is hard to miss. At the time of writing, Kalshi traders price a Senate vote before Oct. 1 at 91%, while Polymarket gives the CLARITY Act an extremely low shot at becoming law this year.

Senate’s Sept. 15 Vote Starts the CLARITY Act Countdown
The Senate left Washington on Aug. 8 after Majority Leader John Thune filed a cloture motion, teeing up a Sept. 15 procedural vote. Cloture generally takes 60 votes and would let the Senate move toward debating and potentially passing the legislation.
Getting there solves only the first problem. According to American Banker reporting, Capital Alpha Partners’ Ian Katz slashed his enactment estimate from roughly 40% to 25%, possibly lower, warning that clearing cloture still would not guarantee passage. Galaxy Digital went further, cutting its estimate to 10% in August as Congress burned through precious calendar days.
Prediction Markets Bet Congress Votes but Cannot Seal the Deal
The cash piling into prediction markets tells essentially the same story. Kalshi’s Senate vote market has pulled in more than $1.25 million in volume, while its broader crypto market structure enactment contract has attracted more than $6.8 million.
Polymarket’s sharper bet on whether H.R. 3633 becomes law in 2026 has drawn roughly $11.5 million. The implied probability sits at a brutal 13%, a stunning collapse from the 82% odds traders were pricing in February.
Three Battles Threaten to Blow Up Congress’ Crypto Rulebook
This fight reaches well beyond another round of Washington theater. The CLARITY Act would create a federal framework for crypto markets, hand the Commodity Futures Trading Commission exclusive authority over spot digital commodity markets and leave the Securities and Exchange Commission overseeing certain securities offerings and exchange activity.
Three fights are now squeezing the coalition needed to find 60 Senate votes: ethics restrictions involving government officials and crypto, stablecoin rewards banks see as competition for deposits, and protections covering decentralized finance (defi) and non-custodial software developers.
Several Democrats who once appeared open to negotiations have attacked the latest text, while banking groups continue hammering stablecoin yield. Republicans, including Sens. Cynthia Lummis, Tim Scott, John Boozman, John Thune, and Thom Tillis remain among the legislation’s strongest backers.
SEC and CFTC Charge Ahead as Congress Burns Through the Clock
Regulators are not waiting around for lawmakers. SEC crypto rulemaking and CFTC work covering exchanges, leveraged trading, and decentralized finance (DeFi) could build major pieces of the regulatory framework without Congress, although future administrations can generally unwind agency rules more easily than federal statutes.
That makes Sept. 15 the pressure point. Even if senators clear the 60-vote procedural barrier, Congress faces a brutal calendar packed with government funding, defense legislation, and approaching midterm elections. Another failure could shove the broader market structure battle into a lame-duck session or 2027.
For crypto firms, banks, and investors, the signal now is not whether Washington keeps talking about CLARITY, but whether senators can scrape together enough votes on Sept. 15 to keep it breathing.
