South Korea Moves to Freeze Crypto Accounts Suspected of Illicit Transfers

South Korea’s ruling Democratic Party has introduced a legislative amendment that would grant financial authorities the power to freeze cryptocurrency exchange accounts suspected of being used for illicit asset transfers. The proposed changes to the Act on Reporting and Use of Certain Financial Transaction Information mark a significant expansion of the country’s anti-money laundering framework for digital assets.

Expanding the Legal Definition of Accounts

The bill, as reported by Digital Asset, introduces a new legal definition of an “account” within the context of virtual asset service providers (VASPs). Under the amendment, an account would be defined as a unique identification number assigned by a VASP to a user for transaction services. This expanded scope brings cryptocurrency exchange accounts explicitly under the purview of existing financial transaction reporting laws, closing a previous regulatory gap.

Currently, South Korean financial authorities have limited direct oversight of individual crypto exchange accounts. The proposed change would allow regulators to treat these accounts similarly to traditional bank accounts when investigating suspicious financial activity.

New Powers for the Financial Intelligence Unit

A central provision of the amendment empowers the Financial Intelligence Unit (FIU), which operates under South Korea’s Financial Services Commission (FSC), to request payment suspensions from both financial institutions and virtual asset service providers. The FIU could issue such requests if it determines there are reasonable grounds to suspect that bank accounts or digital asset accounts have been used to transfer illicit assets.

This authority represents a direct intervention mechanism. Previously, the FIU relied on voluntary cooperation from exchanges or separate court orders to freeze assets. The new bill would create an administrative pathway for rapid action, potentially allowing authorities to freeze assets more quickly during active investigations.

Implications for Crypto Exchanges and Users

For cryptocurrency exchanges operating in South Korea, the bill would introduce a new compliance obligation. Exchanges would be legally required to comply with FIU requests to suspend transactions from flagged accounts. Failure to do so could result in regulatory penalties.

For users, the amendment signals a tightening of oversight. While the measure is designed to target illicit activity, it also raises questions about due process and the potential for administrative errors. The bill does not specify a maximum duration for payment suspensions or outline a clear appeals process for account holders, though these details may emerge as the legislation moves through the National Assembly.

The move aligns South Korea with a broader global trend of governments seeking greater control over cryptocurrency flows. Similar regulatory frameworks exist in jurisdictions such as the European Union under its Markets in Crypto-Assets (MiCA) regulation and in the United States through the Financial Crimes Enforcement Network (FinCEN) guidelines.

Conclusion

The proposed amendment represents a meaningful step in South Korea’s ongoing effort to integrate cryptocurrency transactions into its mainstream financial regulatory system. By granting the FIU direct authority to freeze accounts suspected of illicit transfers, the bill aims to close enforcement gaps that have been exploited for money laundering and other financial crimes. The legislation is now under consideration by the National Assembly, and its passage would mark one of the most direct regulatory interventions in the country’s digital asset market to date.

FAQs

Q1: What exactly does the proposed bill change?
The bill expands the legal definition of an “account” to include unique identifiers assigned by virtual asset service providers (crypto exchanges). It also grants the Financial Intelligence Unit the power to request payment suspensions for accounts suspected of being used to transfer illicit assets.

Q2: Which South Korean government agency would enforce these new powers?
The Financial Intelligence Unit (FIU), which operates under the Financial Services Commission (FSC), would be responsible for issuing payment suspension requests to financial institutions and crypto exchanges.

Q3: Does this bill affect all cryptocurrency users in South Korea?
The bill targets accounts suspected of involvement in illicit asset transfers. Law-abiding users would not be directly affected unless their accounts are mistakenly flagged, which raises questions about the need for a clear appeals process in the final legislation.
