Regulators Are Misjudging Perpetual Futures as Risky Gambling

The gap between how crypto-native and traditional financial minds see market structure widened this week, after DRW CEO Don Wilson directly challenged regulatory narratives that cast perpetual futures as little more than speculative gambling instruments. In a rare public pushback from a Wall Street veteran running a major trading operation, Wilson reframed the instrument as a practical innovation that legacy markets should be adopting, not suppressing. The remarks, detailed in the original report, put fresh pressure on the regulatory conversation at a moment when Washington itself is wrestling with how to classify and oversee crypto derivatives.

The Instrument Regulators Keep Mislabeling

Perpetual futures, or perps, are the dominant trading vehicle in crypto markets. Unlike traditional futures contracts, they have no expiration date. A funding rate mechanism tethers their price to the spot market, preventing the large premium or discount gaps that can appear in traditional futures as settlement approaches. That design makes them ideal for traders who want continuous exposure without needing to roll contracts.

Wilson’s core argument is that regulators are treating perps as a risky outlier when, in practice, they solve problems that even regulated exchanges in equities and commodities have long tolerated. He pointed out that traditional futures markets often grapple with basis risk and expiry-related volatility, issues perps are designed to smooth out. “It’s not inherently risky,” Wilson said, pushing against the assumption that the product class is toxic simply because it emerged in crypto.

A Familiar Pattern of Regulatory Suspicion

The pushback from a figure like Wilson matters because DRW sits at the intersection of traditional and digital markets through its Cumberland trading arm. When someone with decades of market-making experience across asset classes says a crypto derivative isn’t the problem, it complicates the simple narrative that perps are just casino chips for degens. Yet U.S. regulators have historically looked at any product birthed on crypto-native exchanges with skepticism, often defaulting to a lens of investor harm.

That instinct isn’t baseless. The crypto derivatives space has seen repeated failures, from exchange collapses to manipulation on unlicensed platforms. But Wilson’s point is that the instrument’s structure is sound, and that a blanket regulatory posture misses the real issue: the venues and the supervision surrounding them. The distinction between product risk and platform risk is one crypto advocates have long tried to make, and it’s now getting a high-profile advocate.

Broader Implications for Market Structure

The remarks land at a time when U.S. crypto legislation is facing its own cliffhanger moment. As previously covered, major banks are maneuvering to derail a landmark crypto bill demanding changes to a compromise they’d only recently accepted. The episode underscores how deeply legacy financial interests and regulatory philosophy remain intertwined, with derivatives classification often becoming a proxy fight for broader market access.

If perps were eventually embraced by traditional venues with proper clearing and oversight, the liquidity map could shift significantly. Already, the tokenization of real-world assets has crossed $20 billion on-chain, with firms like Ondo and JPMorgan running live settlement tests, as seen in the latest weekly tokenization roundup. The appetite for always-on, settled instruments is real, and perps fit that mold exactly.

Meanwhile, the developer activity supporting the infrastructure behind these markets shows no sign of slowing. Ethereum, BNB Chain, and Polygon continue to lead in weekly active development, as highlighted in recent blockchain activity data. That steady builder momentum suggests the plumbing for more sophisticated derivative products is being laid irrespective of the current regulatory posture.

What Remains Uncertain

Wilson’s call for adoption still faces a steep climb. The U.S. regulatory environment for crypto derivatives is fragmented. The CFTC and SEC share overlapping domain, and neither has yet provided a clear framework that would allow traditional exchanges to confidently list perpetual-style contracts. Even if a perp is structurally sound, legal risk around unregistered securities-like swaps or leveraged retail products is not trivial. Any path forward likely requires legislative clarity, not just industry advocacy.

The conversation also highlights a deeper tension: crypto-native exchanges built their liquidity empires on perps precisely because they were innovative and lightly regulated. Bringing those products into the traditional fold might sanitize them to the point where their margin and leverage mechanics look very different. Whether that’s a net positive for market participants or simply a transfer of volume from unregulated venues to regulated ones remains to be seen.

For now, Wilson’s intervention gives institutional credibility to an argument that has too often been dismissed as crypto cheerleading. It doesn’t guarantee any policy shift, but it adds weight to the idea that perpetual futures are not a design flaw to be corrected—they’re a solution that traditional markets might eventually have to accept.
