Federal Reserve Board member Lisa Cook filed a lawsuit today challenging President Donald Trump’s decision to remove her from office. Cook argued that the White House lacked the authority to do so and insisted she wanted to keep her position.
Cook’s lawsuit, filed in U.S. District Court in Washington, called the dismissal “unprecedented and illegal.” Cook described Trump’s move as an attempt to put political pressure on the independent Federal Reserve to cut interest rates.
This case is seen as the start of a critical legal process for the future of the Fed, an independent institution. Trump has long criticized the Fed and has taken steps to appoint people who share his monetary policy views.
Cook also named the Federal Reserve and Chairman Jerome Powell as parties in the lawsuit, citing their authority to implement Trump’s directives. In a statement about the lawsuit, the Fed stated that it would “comply with the court’s decision.”
Trump announced his dismissal of Cook in a letter shared on social media three days ago. The president claimed Cook was involved in mortgage fraud and claimed he was exercising the “power of removal” enshrined in the Fed’s charter. However, Cook was not charged with or convicted of any crime.
Experts have raised serious doubts about the legal basis for Trump’s decision. The lack of evidence and the fact that the allegations predate Cook’s tenure at the Fed have further fueled the controversy. Furthermore, the fact that Cook was dismissed without a chance to defend himself has been deemed legally problematic.
Cook’s lawyers filed a 24-page brief arguing that impeachment would “weaken” the safeguards granted under the Federal Reserve Act and that Trump violated Cook’s legal rights. The filing argued that the mortgage claims in question did not fall within the law’s “inefficiency, neglect of duty, or abuse of office.”
At the heart of Trump’s allegations is that Cook listed two different addresses as his primary residence, but the lawsuit also provides no clear explanation for this.
