The scope is deliberately tight. The rules target physical products that have AI built in, such as smart devices or toys.
Standalone software, applications and digital tools are explicitly excluded. An AI-powered teddy bear falls inside the lines. An AI chatbot app on your phone does not.
The burden also falls on a specific group. Obligations will sit with supply-chain actors, meaning manufacturers, importers and distributors of the affected goods.
End users are not the target. Neither are developers who only build software.
The timeline, step by step
The rollout is phased rather than switched on all at once. Certain prohibited practices related to embedded AI systems will take effect by November 10, 2026.
Additional obligations will then be phased in through 2028.
The EU AI Act was passed in 2024, built around a risk-based approach that treats AI systems differently depending on how much harm they could cause.
In 2025, the European Commission proposed bringing the product-related elements of the Act into the arrangements covering Northern Ireland. Discussions in the UK-EU Withdrawal Agreement Joint Committee then concluded in May 2026, leading to the agreement now being implemented.
Why Northern Ireland gets special treatment
Northern Ireland occupies an unusual spot in the post-Brexit landscape. Under the Windsor Framework, certain EU rules on goods continue to apply there, even though the region is part of the UK.
This AI decision follows that same logic. Because the EU rules apply to goods, and these are goods with AI inside them, the product-related parts of the AI Act come along for the ride.
The government has stressed one point in particular. No additional regulatory barriers will be constructed between Great Britain and Northern Ireland as a result of the change.
Meanwhile, the bigger question of how AI is governed in Northern Ireland remains a matter for the UK government and Stormont.
What this means for businesses and policymakers
For manufacturers and importers selling AI-integrated products into Northern Ireland, the most immediate consequence is likely to be compliance work. Companies may face initial costs as they check whether their products fall within scope and what the new obligations require.
The near-term impact is expected to be modest. The range of affected products is narrow, and relatively few businesses currently offer physical goods with embedded AI.
The phased timeline through 2028 gives companies room to plan.
Distributors deserve particular attention here. Because the obligations land on supply-chain actors, a company that simply moves AI-enabled products into Northern Ireland may need to understand rules it never had to think about before.
For software developers, the message is the opposite. With standalone apps and digital tools excluded, pure software businesses in Northern Ireland are largely untouched by this specific change.
For now, the immediate milestone is November 10, 2026, when the first prohibited practices for embedded systems take effect, with later obligations phasing in through 2028.
