Connor Brown, Executive Director of the Bitcoin Policy Institute and a former Senate staffer, laid out exactly what’s at stake as the Senate holds a cloture vote today on the CLARITY Act.
Republicans control 53 seats, with two possibly sitting out, meaning 7 to 9 Democrats need to cross the aisle to reach the 60 votes required. Importantly, today’s vote doesn’t decide the bill’s fate outright, it’s a procedural step determining only whether the Senate can move to actual debate and, eventually, a final vote.
Years of Groundwork Behind One Vote
Brown called it the culmination of years of legislative effort, tracing back to the Token Taxonomy Act and the Lummis-Gillibrand framework he worked on personally during his time in the Senate.
He described the current text as Republicans’ “final and best offer” to get something across the finish line before the election, with only a handful of session days remaining on the calendar. “This really is sort of a buzzer-beater moment,” Brown said, “for this legislative package and for a clear set of lasting rules for the digital asset industry.”
Ethics Breakthrough
The provision that’s held up negotiations longest, government ethics restrictions, saw a major shift when Trump agreed to roughly 80% of what Democrats had requested.
Brown called the resulting compromise “pretty compelling,” saying it extends restrictions to officials’ spouses and gives individual states the ability to pursue exchanges and bring injunctions against the Justice Department. “80% of the way there,” Brown said, “sounds like a pretty good deal for something that otherwise would be 0% of the way there.”
He also framed the vote as a fundamental choice, let regulatory agencies like the SEC and CFTC write the industry’s rules unilaterally, or give Congress a direct say instead.
With Senator Cynthia Lummis’s updated draft reportedly securing 115 Democratic-requested changes, Brown said the real question senators face today isn’t whether the bill is perfect, it’s whether Congress wants a seat at the table at all, or whether it defaults to the agencies by default.
