Former Celsius CEO Alex Mashinsky Asks for Trial to Be Postponed Till May 8

Former Celsius CEO Alex Mashinsky has asked to postpone the trial till May 8, however, the Attorney’s Office has not agreed yet.

Celsius’s Alex Mashinsky Requests for Trial’s Postponement

As per latest reports, former Celsius CEO Alex Mashinsky has pleaded guilty to two counts and asked to postpone the trial for one month to May 8. Lawyers representing Mashinsky have requested an adjournment of key deadlines in his ongoing criminal case, citing the ‘complexity of the proceedings’ and the volume of material that needs to be reviewed.

In a letter submitted to U.S. District Judge John G. Koeltl, the defense sought extensions for two deadlines related to the Probation Office’s presentence investigation report (PSR). According to the letter, the defense has requested “that the Court adjourn the deadline for the parties’ objections from February 10, 2025 until February 17, 2025. The defense also requests that the Court adjourn Probation’s final disclosure from February 24, 2025 to March 3, 2025, which will provide Probation with 14 days to respond to the parties’ objections.”

However, Mashinsky’s legal team argued that the extensive nature of the 76-page draft report, combined with the late disclosure of 177 victim impact statements, requires additional time for thorough review. They have requested an extension of the objections deadline to February 17, 2025, and the final disclosure deadline to March 3, 2025. Both the government and the probation Office have not expressed objections to these adjustments.

Additionally, the defense has requested a one-month postponement of ex Celsius CEO’s sentencing, initially scheduled for April 8, 2025, and has instead proposed a new date of May 8, 2025. The attorneys cited the complexity of the case, the severity of potential consequences, and the need to scrutinize the government’s evidence, which they claim often lacks citations and includes undisclosed witness statements. They argued that the additional time till May 8 would allow for a more accurate and comprehensive sentencing submission.

Apart from Mashinsky’s case, Celsius was also in news recently after the firm fought with the court to reopen its $444 million claim against FTX, arguing that decision made by Judge John T. Dorsey regarding the initial claim and amendment should be considered sufficient and valid.
